Mandatory Reconsiderations for PIP and ESA completed using up-to-date precedents and legislation
These are possibly the most underutilised part of the claim process. Often the DWP will invite you to submit a mandatory reconsideration over the phone and, almost always, it will fail if you allow them to do this. Here at PIPP’s we treat a reconsideration the same way that we approach a tribunal submission, including case law relevant to your claim. We will need a copy of your assessment report, application form and any supporting medical evidence and our legally qualified drafting team can then compete this on your behalf. We will also offer advice on how to obtain the medical evidence that you need. You have 13 months and a day from the date of the decision to submit a mandatory reconsideration (although the DWP will often tell you that you only have one month)

Our legally qualified Expert has a 98.5% success rate (as of October 2018) at appeals she attends in person. Throughout 2018/19 she has only been unsuccessful at one appeal and is continuing to support the Claimant to appeal to the upper tier.
If your mandatory reconsideration hasn’t been successful and you instruct us to act for you, we will fill in the notice of appeal form, register with both the DWP and HMCTS as your representative, help you to obtain the evidence that you need to support your claim and build your case for you. We will enter a submission with the court once you have a hearing date, utilising any relevant case law and legislation and then attend with you on the day. We are allowed the opportunity to ask questions of you to ensure that the panel have a clear view of your struggles.

Many claimants have been in receipt of long standing or lifetime awards of Disability Living Allowance and are naturally concerned when the DWP send out the applications forms for PIP. We can support from the point of filling in that form to attending your assessment and onwards in the process. Hopefully when we are involved at the initial stage of the process the transition should be smooth – however if it is not or you are already at risk of losing your award or Motability car then we can help.
